Referring to Law Number 31 of 2000 concerning Industrial Designs, there are several terms that need attention, as follows:

  • Industrial Design is a creation concerning the form configuration, or composition of lines or colors, or lines and colors, or a combination thereof which is three-dimensional or two-dimensional, providing an aesthetic impression and capable of being realized in a three-dimensional or two-dimensional pattern and can be used to produce an industrial product, commodity, or handicraft.
  • Designer(s) is a person or several people who create an Industrial Design.
Stages of the Industrial Design Application Process
  1. Conduct a search to check the novelty of the design to be applied for, including on the pages https://pdki-indonesia.dgip.go.id/, https://designdb.wipo.int/designdb/en/#
  2. Submit the application to IPMO UGM via Simaster.
  3. Administrative examination by the IPMO UGM Team.
  4. Submission of the application by the IPMO UGM Team to the Directorate General of Intellectual Property (DGIP).
  5. Formal administrative examination by DGIP.
  6. Announcement/publication of the industrial design application by DGIP.
  7. Substantive examination by the DGIP industrial design examiner.
  8. Granting or rejection of industrial design rights by DGIP.

The files to be prepared for industrial design registration are as follows:

a. Financing Application Letter

The industrial design financing application letter must be filled out and signed by the head of the designer team without stamp duty.

b. Industrial Design Registration Application Letter

The industrial design registration application form can be filled out by the designer and will be signed by the Head of IPMO UGM.

c. Design Description

The Industrial Design Description form can be filled out according to the following provisions:

  • Title Brief and in Indonesian, referring to the submitted design without indicating its function. Examples: Table, Chair, Cup, etc.

  • Figure Description State descriptions according to each view of the drawing referring to the Industrial Design Drawing template. Example: Figure 1: Front View Figure 2: Rear View Figure 3: Right Side View Figure 4: Left Side View Figure 5: Top View Figure 6: Perspective

  • Utility Explain the utility of the applied design concisely and clearly. Example for table design: Utility: for placing food and/or drinks

  • Claim Filling out the claim for an industrial design application differs from a patent application claim. An industrial design claim simply requires selecting an option available in the form, namely Form/Configuration/Color composition/Line composition, without adding other descriptive sentences.

d. Design Drawings

Design drawings for each view, already prepared in .jpg or .png format, can be copied and then inserted into the Industrial Design Drawing template, then converted to PDF format.

e. Right Assignment Letter

The right assignment letter must have a Rp10,000,- stamp duty on the signature column of the head of the designer team. If there is more than one designer, only one stamp duty is needed for the head of the designer team; other designers sign in sequence without using stamp duty.

*Note: To proceed, Industrial Design applications with joint ownership must submit a softcopy of the Cooperation Agreement (PKS) which includes an IP ownership clause between UGM and the partner. This can be sent via email to hki@ugm.ac.id.

f. Industrial Design Ownership Statement Letter

The Industrial Design Ownership Statement Letter is a declaration that the design submitted by the designer does not imitate or use another person’s design. The statement letter must be filled out, affixed with a Rp10,000,- stamp duty, and will be signed by the Head of IPMO UGM.

    1. Industrial design drawings in .jpg format
    2. Design drawings can be computer-generated designs or camera photos
    3. White background or other colors that make the design shape clearly visible
    4. No other object images besides the design to be registered
    5. For 3-dimensional designs, the design drawings minimally consist of 6 views: front view, rear view, right side view, left side view, top view, and perspective

  1. All letters and forms of the industrial design application files that have been printed, stamped (if required), and signed must then be scanned into PDF format.
  2. All industrial design application forms and letters in PDF format must also include the files in MSWord version (.docx/without signature).
  3. Ensure that all information in the Word file (.docx) is the same as the printed document (PDF); any inconsistent information between the Word file and the printed document will affect the industrial design application data.
  4. Application files (in PDF, MSWord, and .jpg format) must be submitted via the Simaster UGM page.
